Any order placed by the Customer in Alfa Laval’s web shop or any other websites with purchasing possibilities operated by or on behalf of Alfa Laval is not binding on Alfa Laval until and unless, and the shipment of the order is always subject to, Alfa Laval's prior confirmation. Notwithstanding anything to the contrary provided for in any sales terms and conditions, Alfa Laval shall always be entitled to unilaterally suspend or terminate the order, without incurring any liability for damage or loss arising out of or relating to such suspension or termination, if and to the extent performance of the order is impeded or made unreasonably onerous as determined by Alfa Laval at its sole discretion, by any export laws, trade or export restrictions, trade sanctions, embargoes, prohibitions or other regulation imposed by the EU, UN or U.S. or other foreign governments (collectively, “Export Control Laws”), or from any resulting hindrances such as payment, travel or transportation restrictions or limitations, whether foreseen or not at the time of Alfa Laval’s confirmation of the order.

For the avoidance of doubt, Alfa Laval shall always be entitled to suspend or terminate the order if any Export Control Laws, not applicable at the time of Alfa Laval’s confirmation of the order, is recalled (e.g. by way of snapbacks) or in any other way adjusted by competent authorities, if and to the extent performance of the order is impeded or made unreasonably onerous.

The Customer undertakes not to violate any Export Control Laws by using, exporting, re-exporting, transferring or making available any products or any software, data or technical/commercial information supplied by Alfa Laval directly or indirectly through affiliates, third party or otherwise. The Customer shall refrain from any dealings, transactions or other activity involving individuals or entities targeted by Export Control Laws or entities that are owned or controlled by such by individuals. Furthermore, the Customer shall not facilitate any attempt by a third party to circumvent or otherwise assist such third party in any dealings, transactions or activity that, by wilfulness or neglect, might be in violation of any Export Control Laws.
